I. Terms & Conditions

1. Basic Provisions

1.1 These Terms & Conditions apply to all contracts you conclude with us (MBO Tech Spain Business SL) via the Shopify online platform, our web store www.mbo-tech.eu. Any conflicting terms you use are hereby rejected unless we have expressly agreed otherwise.

2. Conclusion of Contract

2.1 Subject matter of the contract is the sale of goods.
2.2 When we list an item on Shopify our web store www.mbo-tech.eu, this does not yet constitute a binding offer to conclude a purchase contract, but rather an invitation for you to submit an order.
2.3 You submit a binding purchase offer by completing the online shopping cart process. You can review and change the contents of your cart at any time before finalizing your order. If you select an instant‐payment service (e.g. PayPal), you will be redirected to the provider’s site to complete payment, then returned to Shopify our web store www.mbo-tech.eu to review your order. Clicking “Submit Order” constitutes your binding offer.
2.4 You will immediately receive an automated e-mail from Shopify our web store www.mbo-tech.eu confirming receipt of your order; this does not yet form a contract.
2.5 The contract is concluded when you receive a separate shipping confirmation (or, for prepayment/bank‐transfer orders, an order-acceptance e-mail) from us via Shopify our web store www.mbo-tech.eu. If you do not receive either confirmation within two days, your order is no longer binding, and any payments made will be refunded promptly.
2.6 Order processing and all contract‐related communications are sent by e-mail, partly automated. Please ensure your e-mail address is correct and capable of receiving our messages.

3. Payment Methods

to process payments. Available methods (as shown on our store www.mbo-tech.eu or during checkout) include:

  • Bank Transfer (Prepayment)

  • PayPal

  • Credit Card via Shopify Payments (Mastercard, VISA, American Express)

  • Sofortüberweisung (Klarna)

  • Invoice (Klarna)

  • Installment Plan (Klarna)

  • Direct Debit (Klarna)

  • Google Pay, Apple Pay

4. Retention of Title

4.1 You may only assert a right of retention for claims from the same contractual relationship.
4.2 Ownership of the goods remains with us until full payment has been received.
4.3 If you are a business customer, we reserve ownership until all outstanding receivables from our ongoing business relationship are settled. You may resell the goods in the ordinary course of business, assigning us your claims against your buyer up to the invoice amount. We will release sufficient collateral upon request if its realization value exceeds the secured claims by more than 10%.

5. Warranty

5.1 Statutory warranty rights apply.
5.2 As a consumer, please inspect delivered goods immediately and report obvious defects or transport damage to us and the carrier without delay. Failure to do so does not affect your legal rights.
5.3 If any product feature deviates from agreed specifications, this only applies if we notified you in advance and you expressly agreed.
5.4 Business customers’ warranty rights are limited to our own product descriptions and the manufacturer’s specifications. We will, at our choice, remedy defects by repair or replacement. If two attempts fail, you may demand a price reduction or contract rescission. The warranty period for businesses is one year from delivery, except in cases of injury, willful misconduct, or if we provided a guarantee of quality.

6. Governing Law, Place of Performance, Jurisdiction

6.1 Spanish law applies, unless it deprives consumers of protection afforded by mandatory law in their country of residence.
6.2 Place of performance and exclusive jurisdiction (for merchants, legal entities under public law, or special funds under public law) is our registered office in Madrid.
6.3 The UN Convention on Contracts for the International Sale of Goods does not apply.

7. Age Restrictions

7.1 For products subject to youth-protection laws, we only contract with customers meeting the minimum age requirement.
7.2 By ordering, you confirm you have reached the legal minimum age and that the delivery recipient is likewise of legal age.
7.3 If required by law, our logistics partner will verify age upon delivery by checking valid ID.
7.4 If a product listing specifies you must be at least 18, these rules apply with “18 years” replacing the statutory minimum age.

We are not willing or obliged to participate in arbitration proceedings before a consumer-conciliation board.

3. Contract Language & Storage

3.1 The contract language is German or English.
3.2 We do not permanently store the full contract text. You can print or save the contract data via your browser before submitting your order. After your order is received, we will e-mail you the order details, legally required information for distance contracts, and these Terms & Conditions.

4. Essential Product Characteristics

All essential features of the goods or services are described in each product listing.

5. Prices & Payment Terms

5.1 All prices shown, including shipping costs, are total prices and include all taxes.
5.2 We do not charge any shipping fees.
5.3 Any bank or currency‐conversion fees for payments made from outside the EU must be borne by you.
5.4 Available payment methods are listed in Section I 3. Unless stated otherwise, payment is due immediately upon conclusion of the contract.

6. Delivery

6.1 Delivery terms, estimated shipping times, and any restrictions are shown in each product listing or via a clearly labeled link on our site. Unless otherwise stated, after 2 working days handling time, the delivery occurs within 3–7 working days after contract conclusion (for prepayment orders, after your payment full cleared payment has arrived in our bank account).
6.2 For consumers, risk of accidental loss or damage passes to you upon delivery. If you choose an unauthorized carrier, risk passes when the goods are handed to that carrier. Business customers bear delivery risk.
